Sufficient grounds are available to explain the delay in filing the instant appeal.

For the reasons stated in the application, the same is allowed. Delay in filing of the appeal is condoned. 3.

Accordingly, CAN 1 of 2021 is allowed.

Re.: MAT 204 of 2021 4.

The appeal is directed against a judgement and/or order dated 14th November, 2019 passed by a Single Bench of this Court.

Since the appellant has refused the quantum of compensation, the respondent No.3/West Bengal State Electricity Transmission Company Limited is entitled to pay just and appropriate compensation to the appellant.

Having regard to the above, this Court directs the respondent No.3/West Bengal State Electricity Transmission Company Limited to assess the quantum of compensation payable to the appellant and pay the same, if so entitled, within a period of three months from date.

The delay and/or earlier refusal of compensation by the appellant shall not stand in the way of the decision of the West Bengal State Electricity Transmission Company Limited.

With the aforesaid observations, the appeal is disposed of.

Consequently all connected pending applications, if any, are also disposed of.

9.

There shall be no order as to costs.

10.
