Mukherjee ...For the State The petitioner has been working as a Civil Defense Volunteer with the department of Disaster Management and Civil Defense since the past eight years. The petitioner's grievance is that the petitioner is getting work only 8 to 10 days a month whereas the volunteers who are nominated for rendering service in Q.R.T. Barracks are getting work for a continuous period of 28 days a month. The petitioner has made representations on November 25, 2022, December 7, and December 8, 2022, but the petitioner's representations have not been considered.

Mr. Banerjee, learned counsel appears on behalf of the petitioner.

Mr. Mukherjee, learned counsel appears on behalf of the respondents.

Considering the submissions made by the parties and the materials placed on record, this Court is of the view that the petitioner has no legal right that can be enforced for being engaged as a volunteer to render service in Q.R.T. Barracks. Therefore, no infringement/violation of the petitioner's legal rights can be alleged to have been committed by the State respondents.

In such view of the matter, this Court is of the view that the writ petition is not maintainable.

Accordingly, W.P.A. 4380 of 2023 is dismissed. Since no affidavits have been directed to be exchanged in the present writ petition, all the allegations contained in the present petition are deemed not to have been admitted by the parties.

All parties shall act on the server copy of this order duly downloaded from the website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
