Petitioner is aggrieved by the fact that in spite of informing the police authorities, there has been interference in peaceful enjoyment of the property at the behest of the private respondents. State has submitted a report. Report reflects that proceeding under Section 126 of BNSS has been drawn up against the private respondent no.3 and other persons.

Having considered that the police authorities are aware regarding an existing dispute, I direct that the police authorities will not interfere with any right, title and possession usages in respect of the property which is an absolute domain of the civil court. However, the police authorities would definitely interfere if there is any breach of the peace and/or

tranquility and/or untoward incident resulting from strained relationship existing between the parties. With the aforesaid observations, WPA 4377 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
