Petitioner is an 82 years old lady, who complains of having suffered torture at the hands of the respondent nos. 5 and 6 and to that effect, information was furnished by one Anup Kumar Roy who claims to be Power of Attorney of Gautam Kedia, younger son of the petitioner. From the averments in the writ petition it is transparent that the respondent nos. 5 and 6 happen to be the elder son and the grandson. As such a family dispute is already persisting.

State has submitted a report. Report reflects that police authorities did not act upon the information as it is of a Power of Attorney holder of the younger son who has informed the police station.

In view of the petitioner being 82 years old lady, I direct that the police authorities would go to the

residence of the petitioner and record her statement. It would be the discretion of the police authorities to take subsequent steps after recording the statement of the petitioner.

Learned advocate appearing for the respondent no.5 and 6 is present and submits that the respondent no.5 and 6 are staying at a different flat and there is no scope of interference with the petitioner or the younger son who stays abroad and rarely visits the premises. Be that as it may, police authorities would record the statement of the petitioner and according to the information received they will take steps in accordance with law.

Accordingly, WPA 4466 of 2025 is disposed of. Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
