C.R.R. No.538 of 2012 (Via Video Conference) D/L7.

August 6, Bpg.

Smt. Suparna Dey

Versus

Central Bureau of Investigation Mr. Abhra Mukherjee, Mr. Sudip Banerjee, Mr. Sauradeep Dutta.

...for the petitioner.

Mr. Anirban Mitra.

...for the CBI.

The present revisional application was preferred against the order dated January 3, 2012 passed by the learned Judge, C.B.I. Court (Special) Alipore, South 24 Parganas in Special Case No.1 of 2012 corresponding to Case No.RC BSK 2010E 0006. Prima facie, it appears that the grievance of the petitioner relate to issuance of warrant of arrest after charge-sheet was filed by the investigating agency. Today, when the matter has been taken up, no information could be furnished by the learned lawyers appearing for either of the parties whether the petitioner has already surrendered or obtained bail or the petitioner was arrested and produced before the court.

The revisional application was admitted on 7.3.2012 and the interim order related to stay of the order issuing warrant of arrest was for a period of one week after the summer vacation of the

said year.

Having regard to the fact that with the passage of time, the nature and character of the order so challenged has apparently become infructuous, I am of the view that no useful purpose would be served by keeping the revisional application pending before this Court. However, the petitioner will be at liberty to agitate his grievance if the situation so warrants.

With the aforesaid observations, CRR 538 of 2012 is disposed of.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
