This writ petition has been filed challenging the inaction on the part of the State respondents in not considering her representation dated 6th January, 2023 submitted before the concerned authority.

The petitioner states that she belongs to Scheduled Caste category. She was working as a 'link worker' at Nirol Sub-Centre, District - Purba Bardhaman. A vacancy was created for the post of ASHA Karmi for the said Sub-Centre. She applied for the post. In column No. 7 of the advertisement dated 6th April, 2022 it was mentioned that the candidates who were trained would be given preference while considering their candidature.

The petitioner submits that she has requisite qualification to be appointed as ASHA Karmi. She appeared before the interview Board for the aforesaid purpose. But, her name does not figure in the panel as a successful candidate. The petitioner asserts that she having requisite qualification as well as experience deserves to be appointed for the post. Narrating the aforesaid facts and circumstances, the petitioner made a representation to the Sub-Divisional Officer, Katwa, Purba Bardhaman seeking redressal of her

grievance, but to no effect.

Learned Counsel appearing for the petitioner submits that his client is not aware of the reason by which she was not empanelled in the panel of the successful candidates.

Per contra, learned Counsel appearing for the State respondents submits that the Selection Committee after considering marks obtained in the Madhyamik or equivalent examinations and the marks obtained in interview selected the eligible candidates. Since, the petitioner could not fulfil the eligibility criteria she was not empanelled. However, having heard learned Counsels appearing for parties and on consideration of the documents annexed to the writ petition, I feel that the writ petition may be disposed of by passing the following order. The petitioner is directed to make a comprehensive representation to the District Magistrate, Purba Bardhaman seeking the reliefs as sought for by her in the writ petition within fifteen days from date. After receiving the representation, the District Magistrate, Purba Bardhaman shall consider and dispose of the representation of the petitioner by a reasoned order upon giving an opportunity of hearing to her within four weeks from the date of receipt of the representation.

Once the order is passed, the respondent No. 3 shall communicate the order to the petitioner within seven days from the date of passing the order.

With the aforesaid directions the writ petition is disposed of.

Since, no affidavit-in-opposition has been invited the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

All parties may act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat copy of the order, if applied for, be supplied to the appellant on priority basis on compliance of necessary formalities, on priority basis.
