Learned advocate appearing for the State draws the attention of the Court to the injury report of the victim and a statement recorded under Section 161 of the Cr.P.C. Injured suffered grievous hurt. Injured suffered a stab injury by a sharp cutting weapon in the stomach and at the neck. Injured implicates another person inflicting the stab injuries on him. However, the injured implicates the petitioner before us amongst other persons in continuing the assault on the injured subsequent to the injured suffering the stab injuries and falling on the grounds.

Considering the active participation of the petitioner in the incident of assault of the victim resulting in grievous hurt on the injured, we are unable to grant anticipatory bail to the

petitioner and the prayer for anticipatory bail of the petitioner is rejected.
