No. 302 of 2018 pending before the learned Additional Chief Judicial Magistrate, Kalyani, Nadia, arising out Kalyani Police Station Case No. 85 of 2008 dated 23.03.2008 under Sections 147/148/353/379 of the Indian Penal Code read with Sections 3/4 of the Prevention of Damage to Public Property Act, 1984.

Learned Public Prosecutor is present with the case diary and has filed the memo of evidence.

The charge-sheet in the present case has been submitted for offence punishable under Sections 147/148/353/379 of the Indian Penal Code read with Sections 3/4 of the Prevention of Damage to Public Property Act, 1984. Initially, the present case had been started also under Section 25 and 27 of the Arms Act and 9(b) of the Indian Explosive Substances Act. Learned counsel for the petitioners submits that he may be granted leave to agitate all the points raised by him in this revision before the learned Trial Court.

Considering the said submission and the nature of offence alleged and also the materials on record in the case diary, the Criminal Revision is disposed of.

The petitioners are at liberty to agitate all the points raised herein before the learned Trial Court. (Shampa Dutt (Paul), J.)
