Mr. Manas Dasgupta .....For the Petitioner The revisional application is listed today for hearing after a long spell of time. The petitioner has appeared on issuance of Administrative Notice. Report received from the Learned Registrar Administration (L & OM) which shows that notice was served upon petitioner. The report is taken on record.

Learned advocate for the petitioner submits that he has appeared after change of brief. The petitioner filed this revisional application under Section 482 of the Code of Criminal Procedure praying for quashing of the impugned order of dismissal dated 16.01.2019 passed by Learned Sessions Judge, Alipore in Criminal Motion No.455 of 2018 arising out of orders dated 17.05.2018 and 30.08.2018 passed by learned Additional Chief Judicial Magistrate, Alipore in A.C.G.R. No.2572 of 2017. Learned advocate for the petitioner submits that the petitioner has already surrendered before the Trial Court on 22.04.2019 and was released on bail. Since the warrant of arrest has been recalled, petitioner is not inclined to proceed any further with this revisional application. Having considered the submission made by learned advocate for the petitioner, I am of the considered view that there is no reason to

proceed any further with this revisional application. The same is dismissed for non-prosecution.

Let a xerox copy of order dated 22.04.2019 be retained with the order.

Let a copy of this order be sent to Learned A.C.J.M. Alipore with a direction to proceed with hearing of the case. (Ananda Kumar Mukherjee, J.)
