Matter relates to transfer of the petitioner based on application dated 10th October, 2021 made on Utsashree Portal seeking transfer on general ground (distance). From a document at page 16 it appears that petitioner was found to be a single teacher by the respondent authorities as a result whereof transfer application of the petitioner was sent back to the school authority where petitioner is presently working.
Today, authority of Kumar Ashutosh Institution (Main) Boys' is represented by learned advocate who has submitted that there are four teachers working in normal section in Bengali. Therefore, petitioner though is a single teacher in higher secondary section in Bengali but due to presence of four Bengali teachers in normal section he should not be treated as a single teacher of Bengali in school. Therefore, aforesaid school authority being respondent no. 5 is directed to forward the transfer application of the petitioner in offline mode to the District Inspector of Schools (SE) Kolkata being respondent no. 4 by 7 (seven) days from date. On receipt of transfer application respondent no.4 shall process the same and forward it to the West Bengal Central School Service Commission for taking decision.
After receiving transfer application Chairman, West Bengal Central School Service Commission being respondent no. 3 shall decide the transfer application of the petitioner by 6 (six) weeks thereafter in accordance with law and the decision shall be communicated to the petitioner by 10 (ten) days thereafter.
It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.
The writ petition stands disposed of.
