Kausik (Allowed) CRM (M) 555 of 2026 In Re: An Application for Bail under Section 483 of the BharatiyaNagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Liluah Police Station Case No. 559 of 2025 dated 31.10.2025 under Sections 329(3)/115(2)/117(2)/303(2)/109/3(5) of the BNS and Sections 8/12 of the POCSO Act.

The petitioner has been in custody for approximately 60 days. The charge sheet has already been filed. It appears that the petitioner and the victim are related to each other.

Having regard to the complicity of the petitioner, as reflected in the case records, in the alleged commission of the offence, this Court is of the view that further detention of the petitioner in custody is not necessary in connection with the present case.

Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand Only), along with two sureties of the like amount each, one of whom must be a local, to the satisfaction of the Learned Judge, Special Court (under the POCSO Act) at Howrah. It is further directed that the petitioner shall appear before the trial Court on every date of hearing until further orders and shall not intimidate any witnesses or tamper with evidence in any manner. Failure on the part of the petitioner to comply with the aforesaid conditions shall entitle the trial Court to cancel the bail granted to the petitioner in accordance with law, without any further reference to this Court. Accordingly, CRM (M) 555 of 2026 stands allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
