Criminal Revisional Jurisdiction (Via video-conference) C.R.R 490 of 2019 In Re: An application under Sections 401 & 482 of the Code of Criminal Procedure.

In the matter of : Ajay Chopra ...Petitioner. The present application has been preferred challenging the order dated 18.01.2019 passed by the learned Chief Judge, City Sessions Court, Calcutta in Criminal Revision No. 173 of 2018. The subject matter of challenge before the learned Chief Judge, City Sessions Court was the order dated 11.07.2018 passed in Case No. C/804 of 2013 by the learned Metropolitan Magistrate, 16th Court, Calcutta.

The order dated 11.07.2018 reflects that the learned Magistrate on an appreciation of the materials placed before him was pleased to fix 07.08.2018 for framing of charge and rejected the application for discharge of the present petitioner. The learned Chief Judge on an appreciation of the order as well as the materials appearing therein was pleased to dismiss the revisional application.

I do not find any issue relating to a substantial question of law being raised before this court when the jurisdiction of this court is being invoked.

Regard being had to the concurrent findings of both the courts below, I am of the opinion that no interference by this court is called for.

Accordingly, the revisional application being CRR 490 of 2019 is dismissed.

All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
