...for the petitioners This revisional application has been filed for expeditious disposal of Title Appeal No. 29 of 2017 pending before the learned Additional District Judge, 15th Court at Alipore. The petitioners who are the respondents/defendants in the title suit have preferred this revisional application as they are aggrieved by the continuous fixing of dates by the learned Court below. The records reveal that the appeal is at the stage of arguments and several dates have been fixed since March 2017 but the arguments have not yet been concluded. It is further submitted that one of the petitioners is 80 years old and is facing serious hardship due to the long pendency of the appeal.

Without going into the merits of the matter and without making any observation on the contentions of the petitioners or the facts of the case, this revisional application is disposed of with a direction upon the learned Additional District Judge, 15th Court at Alipore to dispose of the Title Appeal No. 29 of 2017 within a period of four months from the next date fixed without granting any unnecessary adjournments to either of the parties. The learned lower Appellate Court shall proceed independently and in accordance with law.

The learned Advocate on record for the petitioners is directed to serve a copy of this revisional application upon the opposite parties as also the learned Advocate appearing in the learned Court below along with a server copy of this order immediately. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis.
