AGP Mr. Jaladhi Das ..for the State Learned Counsel appearing for the petitioners submits that the petitioners have made a representation before the State Transport Authority, West Bengal but such representation dated 26th August, 2019 has not been considered by the State Transport Authority, West Bengal being the respondent no. 2 till date.

Mr. Sen and Mr. Das, learned Counsel appearing for the State are present.

Heard both the parties.

As the representation dated 26th August, 2019 has not been considered till date, I request the State Transport Authority, West Bengal being the respondent no. 2 to consider the representation of the petitioner dated 26th August, 2019 at page 56 annexure P2 of the writ petition and pass a reasoned order, as early as possible, preferably within a period of 12 (twelve) weeks from date after giving an opportunity of hearing and to allow the petitioners to

produce necessary documents at the time of hearing in the light of all the rules and notifications in accordance with law. The State Transport Authority, West Bengal being the respondent no. 2 is also requested to communicate such decision at an earliest.

Learned advocate-on-record of the petitioners is also requested to serve a copy of this writ petition to the State Transport Authority, West Bengal along with the order of this court positively within 7 (seven) days from today. With the above direction, the writ petition is disposed of.

There shall, however, be no order as to costs. I make it clear that I have not gone into the merits of the writ petition. All the issues are left open to be decided by the respondent no. 2.

Since no affidavits have been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
