CRIMINAL MISCELLANEOUS JURISDICTION CRM (DB) 715 of 2025 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure, 1973 / Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, arising out of Swarupnagar Police Station Case No.812/2024 dated 28.12.2023 under Section 14A(b) of the Foreigners Act, 1946 and Section 12 of the Passport Act.

The State submits report upon verification of the documents submitted by the petitioner. It appears that the documents are genuine.

In view of the above, further detention of the petitioner is not required.

Accordingly, prayer for bail is allowed.

Accordingly, the petitioner, namely, Sujan Dutta. shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned Additonal

Chief Judicial Magistrate, Basirhat, North 24-parganas subject to condition that he shall remain within the jurisdiction of Swarupnagar Police Station and shall intimate his address where he shall currently reside before the learned trial court, the Investigating Officer and the Officer in Charge of the concerned police station under whose jurisdiction he shall presently reside. The petitioner shall appear before the learned trial court on every date of hearing and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to comply with any of the conditions stipulated above, the trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this court.

The application for bail being CRM (DB) 715 of 2025 is, thus, disposed of.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
