W.P.A. 5054 of 2021 (Susmita Chakraborty vs. The CESC & Anr.) Mr. Avijit Chakraborty .... For the Petitioner Dr. Madhusudan Saha Roy .... For the CESC The grievance of the petitioner is directed against a communication dated 25th January, 2021 issued by the CESC. It is submitted on behalf of the petitioner that the petitioner has applied for fresh electric connection but the respondents authorities have failed to provide the petitioner with any such connection.

The respondent CESC is represented and submits that this is the third application for electric connection being made by the petitioner. It is further submitted on behalf of the CESC that the request of the petitioner is for splitting up load. Learned counsel for the CESC relies on a communication dated 23rd November, 2019 and submits that for splitting up load proper remedy of the petitioner is to approach the OMBUDSMAN in terms of Clause 14 of Regulation 53 of the West Bengal Electricity Regulatory Commission. A copy of the letter dated 23rd November, 2019 is kept with the records.

In view of the submissions made on behalf of the parties, W.P.A. 5054 of 2021 is disposed of by directing the petitioner to approach the OMBUDSMAN in accordance with law within two weeks from date. The OMBUDSMAN is directed to consider and dispose of the representation of the petitioner in accordance with law within four weeks from the date of receipt of such representation after hearing all the parties and passing a reasoned order.

There shall be no order as to costs.
