Exception filed by the petitioner to the report filed by the authority is taken on record.

The petitioner participated in the recruitment process for Constable (GD) in Central Armed Police Force. His name featured in the merit list. The scorecard of the petitioner mentions that he was found fit in the Detailed Medical Examination.
Thereafter his name was enlisted in the list of candidates recommended for appointment with "withheld rank". The petitioner is aggrieved by the same.

On perusal of the report filed by the authority, it appears that the petitioner was found medically unfit in the Detailed Medical Examination on two grounds, (i) defective distant vision 6/12 in both eyes and (ii) overweight BMI-25.50 (weight - 79 kg.). As per the procedure, Detailed Medical Examination report
was conveyed to the petitioner on the date of the examination and his signature was recorded. The petitioner never appeared before Board to receive the result of the medical examination i.e., the memorandum of unfit neither gave his consent for undergoing review medical examination.

The result of the petitioner was erroneously fed as fit in the web utility form as well as in the proceedings by the Recruitment Board. Due to this error, the name of the petitioner was published in the merit list by the Recruiting Authority. After the unfit certificate of the petitioner came to the notice of the authority, the same was intimated to him.

Learned advocate for the petitioner submits that there was no error on the part of the petitioner and it has to be taken that fit certificate was issued by the authority correctly.

Such submission of the petitioner cannot be accepted. It has been pointed out by the authority that the result of the Detailed Medical Examination was erroneously fed in the web utility form.

The report of the Detailed Medical Examination has been handed over to the petitioner as well as placed before this Court. Therein it has been clearly mentioned that the petitioner is unfit on medical grounds. The Court cannot permit a candidate declared medically unfit to be appointed in CAPF which is a
disciplined Force and requires extra fitness for recruitment.

The error which cropped up cannot be permitted to be perpetrated. The same has been rectified immediately on notice. The Court accepts such rectification.

In view of the above, the candidature of the petitioner in the recruitment process cannot be permitted to be accepted.

The writ petition fails and is hereby dismissed.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
