Petitioner is aggrieved by the fact that the private respondents had been attempting to encroach the petitioner's property. With the attending view petitioner complain before the police authorities but the police authorities did not take any steps.

Mr. Ghosh, learned advocate appearing for the State has submitted a report. Report reflects that there was a possibility of encroaching the property of the petitioner. Accordingly, police authorities have drawn up proceedings under Sections 126/135 of the BNSS against the respondent nos. 5 to 8. At present the police authorities have been successful in preventing the private respondents from encroaching the property.

Police authorities are directed to oversee that there is no breach of the peace and/or tranquility and ensure

that over the property in dispute no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 4462 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
