In Re: An application under Article 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973. In the matter of : Sri Shyamal Dutta. ...petitioner. The present revisional application relates to M.R. Case No.16 of 2009 under Section 125 of the Code of Criminal Procedure pending then before the learned Judicial Magistrate, Second Court, Siliguri.

Being aggrieved by the order under Section 125 of the Code of Criminal Procedure, the petitioner approached this Court wherein the quantum of Rs.3,000/- per month each to the wife and the child was so passed with the direction to be paid from the date of the order.

The records of this revisional application reflect that the petitioner till date has not moved the revisional application and overcome the initial stages of admission of the revisional application.

Having regard to the order of the learned Magistrate so passed in the year 2012, I am of the view that the quantum so awarded do not call for any interference by this Court. Accordingly, CRR 281 of 2013 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
