The petitioner was appointed as a Conductor by the North Bengal State Transport Corporation (NBSTC) on or around October 1, 1988. The petitioner was promoted to the rank of Sub-Inspector on July 1, 2009. The petitioner got the benefit of the First Career Advancement Scheme (CAS) in 1998.

The petitioner's grievance is that he was entitled to two benefits under CAS for rendering 20 years of continuous and satisfactory service.

The petitioner claims that two other employees similarly placed like the petitioner were given the benefits of two CAS. The petitioner has been superannuated from service with effect from July 31, 2021.

He made a representation on January 3, 2022 for being granted the benefits of the second CAS. Furthermore, a demand for justice was made on July 2, 2022.

Mr. Aftab, learned counsel appearing on behalf of the petitioner submits that despite the representation dated January 3, 2022 and the demand for justice dated July 2, 2022, no response to the same has been received by the petitioner. Mr. Sen, learned Additional Government Pleader appears on behalf of the N.B.S.T.C.

Considering the submissions of the parties and the materials placed on record, this Court is of the view that justice will be sub-served by directing the Managing Director to the NBSTC/the respondent no. 2 to consider the representation of the petitioner dated January 3, 2022 along with the demand for justice dated July 2, 2022 within eight weeks from date upon giving a personal hearing to the petitioner.

Let a reasoned order be passed keeping in mind the information provided by the petitioner at page 6 of the writ petition.

Let such reasoned order be communicated to the petitioner within two weeks of passing thereof.

With the directions aforesaid, W.P.A. 4416 of 2023 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
