The petitioners are aggrieved by the fact that after the charge-sheet was submitted under Sections 498A/406/34 of the Indian Penal Code and charge being framed, no witness has been examined till date.
Having considered the fact that the case was initiated in the year 2020, subsequent to which the pandemic stalled the regular proceedings of the Court, I am of the view that the learned court cannot be held responsible for the delay which has taken place.
Learned advocate for the petitioners is directed to serve a copy of this revisional application upon Mrs. Anasuya Sinha, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.
The next date of the case has been fixed on 29.06.2023. Learned trial court would ensure regarding the presence of the witnesses on the subsequent date so fixed. No unnecessary adjournment should be granted to either of the parties. All efforts must be taken by the prosecution so that
the documents and material exhibits are made available on the date so fixed for evidence of the witnesses. The trial should be taken to its logical conclusion within a reasonable period of time.
With the aforesaid observations, the revisional application being CRR 659 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
