The petitioner participated in the 1st State Level Selection Test, 2016 for recruitment of Assistant Teachers in Higher Secondary School (Classes - IX - X).

The candidature of the petitioner was rejected on the ground of over-age.

Mr. Panda, learned advocate for the petitioner submits that the petitioner in the year 2013 was within the qualifying age as such applied to participate in the 2013 Selection Process but the said selection process was abandoned. However, the authorities allowed the petitioner to participate in the 2016 Selection Process on the basis of his application made in 2013, therefore, the relevant date to reckon the age of the petitioner is the date when the petitioner applied to participate in the said 2013 Selection Process, the authorities are therefore not

justified in rejecting the candidature of the petitioner on the ground of over-age.

The panel prepared in relation to 2016 Selection Process has expired in the year 2019. The candidature of the petitioner was rejected in the year 2018. W.P.A. 4414 of 2023 is therefore dismissed both on merit and on the ground of limitation.

There shall be no order as to costs.
