The only grievance of the petitioner in the present writ application that due to pendency of the criminal case against the petitioner initiated by the wife of the petitioner for the alleged offence under Sections 85/351(2) of BNSS, the passport authorities have not processed the request of the petitioner for grant of passport.

2. Learned counsel for the petitioner submits that after initiation of the case, the police has submitted the charge-sheet and on receipt of the charge-sheet, the learned Trial Court has taken cognizance upon the charge-sheet submitted by the police.

3. In view of the above, this Court finds that as the matter is pending before the Trial Court, thus the petitioner is given liberty to file an application before the learned Trial Court for praying for permission to go abroad and if any application is filed by the petitioner seeking

permission, the learned Magistrate shall dispose of the said application by taking into consideration of the notification dated August 25, 1993 as expeditiously as possible as the petitioner is intending to go to abroad on March 9, 2026.

4. If the learned Magistrate will pass appropriate order for granting permission, the passport authority shall act in accordance with law for issuance of the passport to the petitioner as early as possible.

5. WPA 4420 of 2026 is disposed of.

6. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
