(A) No. 705 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Nakashipara Police Station Case No. 1136 of 2024 dated 06.12.2024 under Sections 109/121(1)/121(2)/132/221/ 351(2)/3(5)of the BNS and under Section 135(1)(a) of the Indian Electricity Act.

Learned Counsel for the petitioner submits there was verbal altercation between the petitioner and the officers of the electricity company. He has repaid the outstanding dues. He prays for anticipatory bail.

Learned Counsel for the State opposes the prayer for anticipatory bail and submits petitioner had assaulted the officers of the electricity company who had come to disconnect for pilferage of electricity.

We have considered the materials on record. Injury report does not show serious injury on the officers. Petitioner has already repaid the final assessment bill raised for

unmetered consumption. Under such circumstances we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita and on condition that he shall appear before the jurisdictional court and pray for regular bail within a period of four weeks from date.
