Heard learned advocates appearing for the parties. Petitioner has filed this writ petition seeking relief of extension of time to amend the bye-laws of the cooperative society in question as per Section 19 of the West Bengal Co-operative Societies Act, 2016. It appears from record that the Assistant Registrar of Cooperative Societies has already granted three months' time to the society by its order dated 5th December, 2022, for the aforesaid purpose. Petitioner submits that due to unavoidable circumstances and the reasons beyond the control of the petitioner, it could not comply the aforesaid direction of the Assistant Registrar of Cooperative Societies. It appears from record that petitioner has approached the aforesaid authority through its representation dated 3rd February, 2023 explaining in detail the reason for delay in completing the proceedings for amendment of bye-laws within the

stipulated time which is going to expire on 5th March, 2023. It also appears from record that the Assistant Registrar of Cooperative Societies on the aforesaid representation has passed order on 6th February, 2023, allowing the petitioner to take initiative for amendment of bye-laws without any further delay. The grievance of the petitioner is that though the Assistant Registrar concerned has allowed the petitioner to take initiative for the amendment of bye-laws of the society in question, but, it has not extended the time specifically for the said purpose. Considering the facts and circumstances of this case as appears from record and the explanation given by the petitioner in its representation dated 3r February, 2023 for not completing the proceeding for amendment of bye-laws of the society in question within the stipulated time, time to conclude the proceedings for amendment of bye-laws of the society in question is extended by two months from date.

With this observation, this writ petition being WPA 4424 of 2023 stands disposed of.
