Having regard to the reasons so assigned in the application and the fact that liberty of the petitioner is involved, I am inclined to allow the same.

Hence, the condonation of delay, as prayed for, is granted.

Accordingly, CRAN 1 of 2024 is allowed.

CRR 728 of 2024 Report submitted by the ld. Advocate for the State be kept with the record.

The report reflects that warrant, proclamation and attachment issued by the ld. CJM, Suri, Birbhum in connection with Suri P.S. Case No. 382 of 2017 has not been executed till date.

Accordingly, the execution of warrant, proclamation and attachment so issued by the ld. CJM, Suri, Birbhum in connection with Suri P.S. Case No. 382 of 2017 dated 25.9.2017, be stayed till 5th of April, 2024. In case, after checking the records, the ld.CJM, Suri finds that the petitioner was earlier on bail, he may be allowed to continue on the same bail and bond. However, a condition be imposed that for a period of six months, the petitioner will meet with the inspector in charge of Suri P.S. once in a week.

Let a compliance report be submitted by the inspector in charge of Suri P.S. once in a month and, to that effect, satisfaction be recorded by the ld. CJM, Suri in the records.

In case, the petitioner does not appear before the ld. CJM, Suri by 5th of April, 2024, the ld. CJM, Suri would revive the earlier order and direct the police authorities to execute the same at the earliest.

With the aforesaid observations, CRR 728 of 2024 along with CRAN 1 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
