Sanjita Saha @Sangita Saha @Sanchita Saha v. State Of West Bengal
C.R.M. (A) 1182 of 2022 30.03.2022 Sl. 7 Court No.29 sourav (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 08.03.2022 in connection with Swarupnagar P.S. Case No. 2 of 2022 dated 02.01.2022 under Sections 498A/306/506/120B/34 of the Indian Penal Code. And In the matter of: Sanjita Saha @ Sangita Saha @ Sanchita Saha ....petitioner.
Mr. Susnigdho Bhattacharyya, ...for the petitioner.
Mr. Joydeep Roy, Mrs. Sujata Das, ...for the State.
Petitioner seeks anticipatory bail.
Learned advocate appearing for the petitioner submits that the petitioner claims herself to be a friend of the husband and to be falsely implicated.
It is contended on behalf of the petitioner that the husband filed a proceeding under Section 9 of the Hindu Marriage Act for Restoration of Conjugal Rights.
Learned advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that the husband is still absconding. He also submits that the wife died. He refers to the Post Mortem Report. He submits that the wife before her death lodged a complaint against the petitioner and her husband. Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 1182 of 2022 is, thus, dismissed.
