The revisional application has been preferred challenging the order dated 24-11-2022 passed by the learned Additional Sessions Judge, Kalyani, Nadia in connection with Criminal Revisional No. 28 of 2022. The learned Additional Sessions Judge has modified the award of interim maintenance to the tune of Rs.5000/- per month to be paid to the wife. The document on which the petitioner has relied upon reflects that the petitioner's salary is Rs.15639/- . Having regard to one third of the amount being awarded to the wife as interim maintenance, I am of the opinion that no interference can be made in the present revisional application. The petitioner submits that he has ailing parents as well as he is a nerve patient and he cannot travel long distance. Let the same be produced in evidence in course of the trial. Learned Magistrate will consider the same in accordance with law and decide whether any alteration of the final maintenance amount would be required at the end of the trail. With the aforesaid observations, the revisional application being CRR 663 of 2023 is disposed of.
