Mr. Biswaroop Bhattacharya, learned Counsel appearing on behalf of the appellant has very fairly submitted at the outset that due to the recording in the second paragraph of the impugned order, the appellant debarred from preferring any appeal. However, he submits that the appellant had never agreed that there is no scope for passing any interim order at this stage and has apprised this Court that the appellant shall approach the learned Single Judge for modification of that portion of the order which records an agreement that there is no scope for passing any interim order at this stage. In view thereof, the appeal and the application stand dismissed as withdrawn.

The appellant shall take appropriate steps in the matter. Affidavit of service filed in Court today be kept with the record.
