Das .....For the State The subject-matter of the present revisional application relates to quashing of the proceedings in respect of G.R. Case No.378/19 arising out of Dankuni Police Station Case No.40 of 2019 dated 01.03.2019 under Sections 420 / 376 of the Indian Penal Code.

Petitioner approached before this Court at a stage when the charge-sheet was submitted and the case was pending for commitment before the Learned Sessions Court.

In view of the contentions so advanced by the learned advocates appearing for the petitioner, de facto complainant and the State, I do not find any reason to interfere with the proceedings without the deposition/evidence of the victim being recorded before the Learned Trial Court.

Accordingly, Learned A.C.J.M., Srirampur is directed to commit the case to the Learned Sessions Judge by 31st December, 2022. Charges be framed by the Learned Sessions Court by 31st January, 2023. Let the deposition of the victim be recorded by 15th March, 2023. Petitioner would be at liberty to approach before this Court after the evidence of the victim is over.

With the aforesaid observations, IA No. CRAN 1 of 2021 is dismissed as not pressed.

Accordingly, C.R.R.483 of 2021 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
