This is an application under Section 24 of the Code of Civil Procedure for withdrawal of an application under Section 25 of the Guardians and Wards Act, 1890 being Misc. Case No. 173 of 2023filed by the father of the minor son of the parties, the opposite party herein from the 2nd Court of the Learned Additional District Judge, Barrackpore, District : 24-Parganas (North) and transfer of it to any Court competent to try and dispose of the said misc. case under the Judgeship of the learned District Judge at Alipore, District : 24-Parganas (South).

Learned Advocate for the petitioner/applicant submits that during the pendency of the instant application, the Court where the said Misc. case was pending, by the order dated March 18, 2024, has returned the said application for custody to the opposite party for filing of the same before the appropriate court having jurisdiction to entertain it, she files a copy of the said order, let it be kept with the record.

In view of such development, the instant application has become infructuous, C.O. 591 of 2024 is dismissed as such without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
