None represents the respondents. Affidavit of service filed in Court is taken on record.

The petitioner alleges that the objection filed by the petitioner alleging construction over an irrigation canal is pending consideration at the end of the Executive Engineer, East Midnapore Division, Irrigation & Waterways Department.

Without entering into the merit of the said representation, the instant writ petition is disposed of by directing the respondent no. 3, the Executive Engineer, East Midnapore Division, Irrigation & Waterways Department to consider and dispose of the said representation in accordance with law, after giving reasonable opportunity of hearing to all the necessary parties, and by passing a reasoned order at the earliest but positively within a period of eight weeks from the date of communication of this order.

If the allegation of the petitioner is found to be proper, then necessary consequential steps shall be taken by the said authority.

Learned advocate for the petitioner is directed to forward to the aforesaid respondent a copy of the representation dated 29th January, 2024 received in the office of the Executive Engineer on 30th January, 2024 at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
