Mr. Samiran Giri ... for the Petitioner Ms. Chama Mukherjee Ms. Manika Pandit ..for the State Let the affidavit of service be taken on record. The petitioner seeks implementation of the order of this Court dated January 7, 2021, passed in WPA 15169 of 2019.
The prayer for enhancement of remuneration of the petitioner who was allegedly serving as a casual worker had been rejected by the Joint Secretary to the Government West Bengal, Department Panchayats & Rural Development.
Such communication was made on June 10, 2019 to the Additional District Magistrate, Purba Medinipore. The decision was challenged before this court.
Upon perusing other documents, which were submitted by the petitioner in WPA 15169 of 2019, the said writ petition was disposed of by an order dated January 7, 2021. Liberty was granted to the petitioner to file a representation along with all supporting documents in respect of his prayer for enhancement of his remuneration, before the respondent no.2.
The respondent no.2 was directed to consider the said representation in accordance with law with reference to the relevant rules/memoranda/ circulars and supporting documents, to be filed by the petitioner.
It appears that the Special Secretary to the Government West Bengal, Department Panchayats & Rural Development asked the Block Development Officer, Contai-III Development Block for clarification as to whether the petitioner had been engaged against any sanctioned vacant post or not. The Additional Secretary to the Government of West Bengal, Department of Panchayats & Rural Development, asked the Block Development Officer Contai-III Development Block, to furnish certificates and year-wise attendance of the petitioner for consideration of the claim for enhancement of financial and other benefits as per the government memoranda.
It appears that the Block Development Officer, Contai-III Development Block, submitted necessary documents before the Additional Secretary, Government West Bengal, Department Panchayats & Rural Development, by a letter dated September 24, 2021.
The petitioner is aggrieved because neither the Additional Secretary nor the Joint Secretary of the
Department of Panchayats & Rural Development, Government of West Bengal, have taken any steps as per the direction of this Court.
This writ petition is disposed of with a direction upon the respondent no.2, that is, the Joint Secretary to the Government of West Bengal, Department of Panchayats & Rural Development, to dispose of the entire issue as per the earlier order of this Court and pass necessary orders in this regard.
The documents that have been forwarded by the Block Development Officer, Contai-III Development Block and the documents which have been furnished by the petitioner, shall be considered.
reasoned order shall be passed and communicated to the petitioner.
The entire exercise shall be completed within a period three months from the date communication of this order.
The time period as mentioned hereinabove, is peremptory.
This writ petition is disposed of.
However, there will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
