This is an application for bail in connection with Chapra Police Station Case No. 413 of 2020 for committing offence punishable under Sections 498A/304B/34 of the Indian Penal Code at the behest of the petitioner.
Learned Advocate for the petitioner submits that the petitioner being the husband of the deceased victim has been languishing in custody nearly for eight months. It is further submitted that the husband/petitioner has been falsely implicated in this case without revealing any overt act performed in the alleged offence leading to the death of the deceased.
Learned Advocate for the State raises objection against the prayer for bail drawing our attention to the statement of the mother of the deceased recorded under Section 164 of the Code of Criminal Procedure and the Post Mortem report.
It appears that the deceased victim suffered death by committing suicide eight months after her marriage, when she was carrying pregnancy. There are materials revealing that deceased victim was put to suffer cruelty, oppression by her in-laws members including the husband/petitioner and being oppressed by the in-laws members, the victim committed suicide.
Having considered the submissions of both sides and bearing in mind the direct involvement of the husband/petitioner in the alleged offence, we are not inclined to grant bail to the petitioner at this stage. Therefore, the prayer for bail of the petitioner is considered and rejected.
The application for bail being CRM 1945 of 2021 is disposed of.
