The allegation is under several sections of the NDPS Act. Out of 11 accused persons, six are in custody. State says that the petitioners are absconding along with two other accused persons.

We have seen the statements of local witnesses recorded under Section 161 of the Code. We have seen the other material in the Case Diary.

In view of the nature and gravity of the offence that the petitioners have been charged with, although chargesheet has been submitted, we are not inclined to grant anticipatory bail to the petitioners.

However, if the petitioners surrender before the learned trial court within a week from date, they will not be arrested for a month from date. If the petitioners apply for regular bail before the appropriate court upon notice to the State, such application shall be considered in accordance with law without being influenced by any observation in this order.

The application for anticipatory bail being CRM 1947 of 2021 is accordingly disposed of.
