Petitioner is one of the accused and Human Resource Executive of one "Convolution Education" within police station Jadabpur. The complainant also runs an institution under the name and style of "IT for Yuva" at Ghatal. The allegation against the present petitioner and others is that they being the representatives of Convolution Education executed an agreement with the institution of the complainant that they would secure jobs for the students of the complainant's institution on condition that the candidates would pay Rs.2,97,000/- each. Some candidates paid the said amount and their names were also registered. But they did not get any job. The accused persons also did not repay the amount. On such allegation,

police took up the case for investigation and submitted charge-sheet in the Trial Court. The case was registered as G.R.Case No.42 of 2018. The case is pending for consideration of charge. On submission of charge-sheet, prima facie case against the petitioner has been established. In view of such circumstances I do not find any merit in the instant revision and accordingly, the instant revision is summarily dismissed. However, it is submitted by the learned Advocate for the petitioner that the Investigating Officer did not seize any document regarding payment of money to Convolution Education during investigation. The petitioner is at liberty to agitate the point at the time of consideration of charge in the Trial Court and the Trial Court shall consider this aspect without being influenced in any way on the observation made hereinabove by this Court in the instant revision.
