Apprehending arrest in connection with Rejinagar Police Station Case No. 273 of 2018 dated 18.10.2018 under Sections 375/411/413/414 of the Indian Penal Code, the petitioner has filed the instant application for anticipatory bail. A plea has been taken by the petitioner that he has been falsely implicated in the instant case solely on the basis of the coaccused's statement. It transpires from the record that there is another case registered against the petitioner on identical charges and he alleged to have misused the privilege granted to him in such case. According to the learned Advocate for the State that he is absconding since last three years and, therefore, his prayer for anticipatory bail should be rejected.

In view of the facts and the antecedents as revealed in course of hearing, we do not think that it is a fit case where the petitioner should be extended the benefit of Section 438 of the Code of Criminal Procedure.

Accordingly, the prayer for anticipatory bail of the petitioner is

rejected.

The application for anticipatory bail, being CRM 1953 of 2021 is thus dismissed.
