AD 71 April 7, 2026 Ct. 28 SG CRM(A) 709 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bagdah P.S. Case No.591 of 2025 dated 09.07.2025 under Sections 21(C)/29 of the NDPS Act.

Alamgir Ms. Soma Mal Ms. Rabia Khatoon Ms. June Modak ... for the petitioners Mr. Ranadeb Sengupta Ms. Sanjida Sultana ... for the State Learned counsel for the petitioners submits that other than the statement of a co-accused, there is no material available against the present petitioners.

Learned counsel for the State opposes the prayer for anticipatory bail, relies on the case diary and submits that other than the statement of a co-accused, there are two statements of local witnesses who had seen the present petitioners flee from the place of occurrence after the arrest of the other co-accused along with the contraband was effected by the BSF personnel.

Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
