Petitioners are aggrieved by the order dated 28.11.2023 passed by the learned Additional Sessions Judge, 3rd Fast Track Court, Berhampore, Murshidabad in Criminal Appeal No.01 of 2021.

The issue relates to maintainability of the appeal at the instance of the de facto complainant.

Having considered the submissions so advanced, I am not convinced. However, as the appeal is still pending before the learned Additional Sessions Judge, 3rd Fast Track Court, Berhampore, Murshidabad, petitioners along with the merits would argue the same as additional point at the time of hearing of the criminal appeal.

With the aforesaid observations, CRR 729 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
