Affidavit-of-service filed on behalf of the petitioner is taken on record.

The writ petitioner is a retired Headmaster, who superannuated on 31st January, 2023. After superannuation of the writ petitioner, Pension Payment Order was issued vide memo dated 5th February, 2023 releasing retiral dues in favour of the petitioner. The writ petitioner claims interest on gratuity due to delayed payment.

State respondents are represented by learned advocate.

Accordingly, the Director of Pension Provident Fund, and Group Insurance, West Bengal and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the writ petitioner on gratuity from the date following the date of retirement of the petitioner till the date of

release of gratuity, within a period of eight weeks from the date of communication of this order. 5.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

Leave is granted to the learned advocate representing the petitioner to amend the cause title in course of this day and described the respondent authority appropriately against respondent no.4. 7.

However, service of notice upon newly added respondent is dispensed with since State respondents are represented by learned advocates. 8.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
