Bhattacharyya Mr. Sarthak Burman ... for the petitioner Mr. Subhendu Sengupta ... for the State Mr. Sumit Kumar Panja Mr. Sumit Roy ... for the WBSETCL The petitioner contends that his land, situated at Dag No. 218 and 220, Khatian No. 2/1, under Mouza - Chota Kandra under Goaltore Gram Panchayat, Police Station - Goaltore, District - Paschim Medinipore, had been utilized by the West Bengal State Electricity Transmission Company Limited for construction of transmission lines. The petitioner is aggrieved for nonpayment of compensation. The writ petition is disposed of with a direction upon the Chief Engineer (Projects - I), West Bengal State Electricity Transmission Company Limited to treat the writ petition as a representation and dispose of the same in accordance with law upon hearing the petitioner and the representatives of the Transmission Company, who were involved with the project.

The authorities shall decide on the factual aspects to be relied on by the respective parties as to the entitlement of the petitioner to compensation. If it is found that the petitioner would be entitled to compensation as alleged, then necessary directions for release of fund shall be issued. The entire exercise shall be completed within four months from the date of communication of this order.

All the parties are to act on the basis of the server copy of the order.
