The petitioner has been in custody for more than seven months. It appears that the petitioner is the brotherin-law of the victim. The charge-sheet has already been submitted, and there is no likelihood of the trial being concluded in the near future.
Having regard to the nature of the allegations, as apparent from the statement of the victim recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and considering the period of detention already undergone by the petitioner, this Court is of the view that
further custodial detention of the petitioner is not necessary.
Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of the like amount each, one of whom must be local, to the satisfaction of the learned Additional District and Sessions Judge, 1st Court, Berhampore, Murshidabad.
It is further directed that the petitioner shall appear before the learned trial Court on every date of hearing until further orders and shall not intimidate any witnesses or tamper with evidence in any manner. Failure on the part of the petitioner to comply with the aforesaid conditions shall entitle the learned trial Court to cancel the bail granted to the petitioner in accordance with law, without any further reference to this Court.
Accordingly, CRM(M)/585/2026 stands allowed.
