Officer-in-charge, Amherst Street Police Station has given instructions dated 21st September, 2021 to the Counsel for the State. The same is taken on record.

It appears from the said report that the mother of the writ petitioner, namely, Smt. Sangita Prasad has sold the vehicle in question to a third party against a sum of Rs.2,00,000/-. It further appears that the signatures have been sent to the handwriting expert and the said signatures have been confirmed.

This Court is of the view that the writ petition is in abuse of process of law. The writ petitioner has sought to unleash his personal family rivalry by making wild allegations against the police and the private respondents.

The writ petition shall stand dismissed with costs assessed at Rs.5,100/- (Rupees five thousand one hundred only) payable by the writ petitioner to the Amherst Street Police Station that shall be earmarked for the Police Welfare Fund.
