Heard learned counsels for the parties.

The petitioner is the State President of Parshwa Shikshak Oikya Manch and seeks to hold a rally from 11 a.m. on 27th February, 2026 from PNB More, Bidhannagar to Bikash Bhawan, Bidhannagar and thereafter a sit-in demonstration at the Y Channel, Bidhannagar (in front of the statue of Bidhan Chandra Roy) till 6th March, 2026. The petitioner applied for the said permission from the police authority in this regard which was turned down. Learned counsel for the State submits that there should be a specific time frame for the said sit in demonstration.

In reply, learned counsel for the petitioner submits that the petitioner shall not use the microphone after 8 p.m.

Upon consideration of the submission made on behalf of the parties, this Court directs that the

organization shall hold the rally on 27th February, 2026 from 11 a.m. from PNB More, Bidhannagar to Bikash Bhawan, Bidhannagar and thereafter a sit-in demonstration at the Y Channel, Bidhannagar (in front of the statue of Bidhan Chandra Roy) which shall continue till 8 p.m. on 6th March, 2026 subject to the following conditions:

1. Number of participants shall not be more than 500 at any point of time.

2. The rally shall be made in an absolutely peaceful manner and no inciteful or provocative speech shall be made.

3. The rally should stick to the extreme left side of the road and shall not impede free flow of traffic.

4. The rally or the sit in demonstration shall not hinder vehicular movement or movement of the public at large in any manner.

5. Microphones used in the rally and sit-in demonstration shall be used within the permissible limits as laid down by the Hon'ble High Court at Calcutta and West Bengal Pollution Control Board.

6. The petitioner shall provide the name and mobile phone numbers of at least 20 volunteers to the police personnel. They shall be responsible in

the event of any untoward incident and shall maintain liason with the police authority.

7. Sufficient police personnel shall be deployed in and around the place in order to ensure maintenance of law and order.

8. The participants shall abide by the instructions given by the police personnel at the spot.

9. The participants shall disperse within 1 hour of completion of the demonstration.

The area shall be appropriately cleaned and restored to its original condition within 24 hours of the demonstration.

With the above observation and directions, the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
