This revisional application has been filed with a prayer for expeditious disposal of the Title Execution Case No. 3 of 2015 where Misc. Case being no. 9 of 2015 was registered following an application under Section 47 of the Code of Civil Procedure pending before Learned Civil Judge (Senior Division), 5th Court, Alipore, 24th -Parganas (South).

Learned counsel appearing on behalf of the petitioner has submitted that after obtaining decree, execution case was filed in the year 2015 and since then, it is pending.

One application under Section 47 of the Code of Civil Procedure was filed by the judgmentdetor which was registered as Misc. Case no. 9 of 2015.

Learned Counsel appearing on behalf of the petitioner prays for necessary direction for

expeditious disposal of the Execution Case no. 3 of 2015 along with Misc. case no. 9 of 2015. Considering the prayer of the revisional application, I find hardly any necessity to ask the petitioner to serve notice upon the opposite parties. Thus, service of notice upon the opposite parties stand dispensed with.

Regard being had to the above, the revisional application stands disposed of with a request to the learned Civil Judge (Senior Division), 5th Court, Alipore to dispose of the Title Execution Case no. 3 of 2015 along with Misc. Case No. 9 of 2015, preferably within twelve weeks from the date of communication of this order as both the Execution Case and Misc. Case are pending for the last nine years. Learned counsel appearing on behalf of the petitioner is at liberty to communicate this order to the learned Executing Court forthwith for compliance.

All the parties shall act on the basis of a server copy of the order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
