The State of West Bengal and ors.

1. None appears on behalf of the petitioner on call. No accommodation is sought for. Even on earlier occasions, none appeared on behalf of either of the parties on call.

2. This case pertains to the year 2010, almost 15 years have been elapsed. It seems writ petition may be disposed of on merits on the basis of materials available on record considering the nature of prayer and long pendency.

3. The petitioner has approached before this court by filing the writ petition praying for a direction upon the respondent authorities to consider the representation dated 02.12.2009 being Annexure P/3 of the writ petition and to allow the petitioner to continue her service.

4. The contention of the petitioner is that the petitioner came to know from the reliable source that the Managing Committee is going to

terminate her service without valid reason in a mala fide and arbitrary manner.

5. Such prayer is not tenable in the writ petition, since no cause of action has been arisen as it was filed at the premature stage.

6. In the above backdrop, the instant writ petition being WPA 3200 of 2010 is dismissed without any order as to costs.

7. Consequently, the connected applications, if any, are also, thus, disposed of.

8. Interim order, if any, stands vacated.

9. All parties shall act in terms of the server copy of this order duly downloaded from the official website of this Court.
