Mr. Kanchan Ray .....For the State This is an application under Section 482 read with Sections 397/ 401 of the Code of Criminal Procedure, 1973 praying for stay of all further proceedings of the case pending before the learned Court of Additional Sessions Judge, Rampurhat, Birbhum in Sessions Trial No.35 of 1997 arising out of Nalhati P.S. Case No.9 of 1995 dated 4th February, 1995 under Sections 302 / 34 of the Indian Penal Code and 9B (II) of the I.E. Act corresponding to G.R. No.58 of 1995.

The matter appeared before a Co-ordinate Bench of this Hon'ble Court on 1st March, 2006. However, no interim order was granted and since then the matter is pending before this Hon'ble Court.

None appears on behalf of the petitioners.

Considering the long pendency of the matter, this Court finds no reason to keep the matter pending any further. Accordingly, criminal revisional application being, C.R.R 537 of 2006 stands dismissed for default.

Let a copy of this order be sent to the Trial Court below by the Department forthwith.
