27.02.2023 Ct. No. 29 KAUSHIK DO C.R.M. (NDPS) 354 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with N.D.P.S. Case No. T.R. 45 of 2021 dated 24.09.2021 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act.

And In Re : Raseed @ Rasid Ali ...... petitioner Mr. Ayan Basu Mr. Sumit Routh Mr. Rajnish Kalawalia Mr. Abdullah Bin Masi ....for the petitioner Mr. Pulakesh Bajpayee Mr. Subrata Santra ....for the NCB Petitioner is in custody in excess of one year six months. The charges could not be framed as other co-accused are still at large.

In such circumstances, the prosecuting agency will take steps to split up the case.

Commercial quantity of narcotic was seized from the possession of the petitioner. The petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

In such circumstances, we are unable to grant bail to the petitioner.

In such circumstances, prayer for bail of the petitioner is rejected and the application being CRM (NDPS) 354 of 2023 is disposed of.
