Allegation of forgery of the stamp paper is made in respect of the deed presented for registration. In such circumstances, in my view, interest of justice would be sub-served by permitting the petitioner to deposit the money equivalent of the stamp duty presented for registration to the deed concerned with the authorities. Upon the authorities receiving such deposit, the authorities will issue the certified copy of the deed presented for registration to the petitioner. It will be open to the authorities to initiate appropriate proceedings against the petitioner if the authority is of the view that the petitioner is guilty of the forgery.
WPA 3474 of 2020 is disposed of without any order as to costs.
