The petitioner was an assistant teacher of Sammilani High Madrasah, District Bankura. The service of the petitioner has been terminated by the impugned notice and the petitioner by the instant writ petition is praying for reinstatement of his service.

The petitioner has been found guilty in a criminal case under the POCSO Act and Indian Penal Code. His sentence although has been suspended in an appeal against the judgment of the Criminal Court but such suspension of the sentence itself does not give him a right to be reinstated in his service, therefore the said prayer of the petitioner cannot be entertained at this stage.

The writ petition is dismissed without any order as to costs.
